I think this will be overturned. 12 weeks comes long before viability (estimated at about 24 weeks) so this law violates the standard set in Roe v. Wade and upheld in Planned Parenthood v. Casey. 12 weeks is now the shortest time frame in the country and 20 weeks was just overturned in Idaho. It has been well established by the Supreme Court that to ban pre-viability abortions is unconstitutional so I do not see a way this bill survives. I’m guessing the legislature knows this but passed it as a way to send a message and stir up controversy

It’s not constitutional, since it does go against the decision of Roe v. Wade that a woman has until the end of the 2nd trimester. It did grant the states power to decide how abortions should be handled in the 2nd trimester (12-24 weeks) though, after the point where Arkansas has banned them. They were never given the power to ban them during the 2nd trimester, just regulate them so each state could impose tougher restrictions. But regardless of what happens in this case, I believe it will be overturned as well, since it goes against cases that the Supreme Court has already made decisions on.
Something else to watch out for: North Dakota PASSED a ban on abortions as soon as a heartbeat is detected (typically after 5-6 weeks). The AR and ND senates seem to be making their decisions simply on personal values, rather than laws.
